Three-Year Limited Warranty for ICC Dive Products
Effective Date: 11/19/24
This Three-Year Limited Warranty ("Warranty") applies to all eligible products purchased from ICC Dive, a division of Incredible Chic Collections® LLC, through iccdive.com or authorized retailers. This Warranty is offered to the original purchaser ("Customer") and is non-transferable. By using an ICC Dive product, you agree to the terms and conditions of this Warranty.
1. Scope of the Warranty
This Warranty covers defects in materials and workmanship under normal use and care for a period of three (3) years from the date of purchase ("Warranty Period").
2. What This Warranty Covers
- Defects in materials, including metals and finishes.
- Issues arising from manufacturing defects in craftsmanship.
- Structural integrity, including links, clasps, and other functional components.
3. What This Warranty Does Not Cover
This Warranty does not cover the following:
- Normal wear and tear, including scratches, fading, or discoloration due to exposure to chemicals, moisture, or sunlight.
- Damage caused by misuse, abuse, negligence, or improper handling.
- Unauthorized modifications, repairs, or alterations.
- Loss, theft, or damage caused by accidents or natural disasters.
- Products purchased from unauthorized retailers.
4. Warranty Claim Process
To make a warranty claim:
- Contact ICC Dive at storeiccdive@gmail.com with your order number, proof of purchase, and a description of the defect.
- If required, ship the defective product to the address provided by our Customer Service team.
- Customer is responsible for shipping costs to ICC Dive. For valid claims, ICC Dive will cover return shipping of the repaired or replaced product.
5. Remedies Under This Warranty
For validated claims during the Warranty Period, ICC Dive will, at its sole discretion:
- Repair the defective product, or
- Replace the product with the same or a comparable item, or
- Issue a refund if repair or replacement is not feasible.
Note: Replacement products may vary in style, finish, or material based on availability.
6. Disclaimer of Implied Warranties
To the maximum extent permitted by law, all implied warranties, including but not limited to warranties of merchantability and fitness for a particular purpose, are hereby disclaimed. If such disclaimers are prohibited under applicable law, the duration of any implied warranty shall not exceed the Warranty Period.
7. Limitation of Liability
ICC Dive’s liability under this Warranty is limited solely to the repair, replacement, or refund of the defective product as described above. In no event shall ICC Dive be liable for incidental, consequential, or punitive damages, including but not limited to loss of use or loss of profits.
8. Jurisdiction
This Warranty is governed by the laws of the State of California, without regard to its conflict of laws principles. Any disputes arising from or related to this Warranty shall be resolved exclusively in the courts located in Los Angeles County, California.
